Terms of Service

1. Acceptance of Terms

By accessing our website, requesting emergency roadside dispatch, scheduling on-site repairs, or approving repair work from Axle Surgeons® of Central PA ("we," "us" or "our"), you ("Customer," "Fleet Manager," or "Driver") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not request or authorize our services.

2. Mobile Dispatch & Service Area

When you fill out a contact form, request a quote, or call/text us for repair service, we may collect:

  • Coverage Area: Mobile dispatch operates within a 100-mile radius of Thompsontown, PA 17094 (covering key corridors including I-87, I-78, I-83, PA Turnpike / I-76, US-15, US-22 / 322, and surrounding Central PA counties).
  • Response Times: Estimated arrival times provided during phone calls or text messages are estimates only. Traffic delays, severe weather, highway safety conditions, and emergency dispatch volume may impact actual arrival times.

3. Customer Responsibilities & Technical Data

To ensure safe, accurate, and rapid repairs, the Customer agrees to provide complete accurate information prior to dispatch:

  • GVWR Verification: The Customer is strictly responsible for providing the correct Gross Vehicle Weight Rating (GVWR) and axle specifications. Correct GVWR is required to select the precise replacement spindle, metallurgy, and mobile machining setup for your rig.
  • Safe Service Location: The Customer or driver must ensure the repair site (highway shoulder, parking lot, or fleet yard) is safe and legal for our mobile service vehicles to operate. If a site is deemed unsafe by our technician, the vehicle must be towed to a safe location before work begins.
  • Property Authorization: The Customer warrants that they own the vehicle or are an authorized representative with full authority to order repairs and allow access to the work site.

4. Pricing, Estimates & Payment Terms

  • Quotes: Service estimates provided over the phone or online are based on initial customer descriptions. Final pricing may be adjusted upon visual inspection if additional damaged components (e.g., burnt bearings, cracked spider plates, damaged hubs) are discovered.
  • Payment Due Date: Payment is due immediately upon completion of service unless a pre-approved commercial fleet account or billing arrangement has been established prior to dispatch.
  • Accepted Forms of Payment: Credit card, electronic fleet transfer, or agreed-upon commercial account payments.
  • Delinquent Accounts: Overdue invoices are subject to late fees and collection costs as permitted by Pennsylvania law.

5. Workmanship & Warranty

  • Patented Replacement Process: Spindle replacement services utilize specialized 5-inch insertion techniques to ensure precise alignment and structural strength without requiring complete axle housing replacement.
  • Warranty Coverage:Axle Surgeons® of Central PA warrants repair workmanship under standard commercial operating conditions. Specific warranty terms for replacement spindles, spider plates, and wheel end components will be detailed on your official invoice.
  • Warranty Exclusions: Warranty coverage does not apply to damage caused by gross vehicle overloading beyond legal GVWR limits, secondary vehicle accidents, improper ongoing wheel bearing maintenance, or subsequent unauthorized modifications.

6. Limitation of Liability & Downtime Claims

To the fullest extent permitted by law:

  • Indirect Damages: Axle Surgeons® of Central PA shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to lost freight revenue, driver delay fees, cargo spoilage, towing costs incurred prior to our arrival, or secondary downtime expenses.
  • Maximum Liability Our total liability for any claim arising out of service provided shall not exceed the total dollar amount paid by the Customer for that specific repair job.

7. Intellectual Property & Trademarks

"Axle Surgeons®" is a registered trademark. All branding, service processes, content, images, and text on this website are protected intellectual property. Unauthorized commercial reproduction or use of our branding is strictly prohibited.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles. Any legal action arising from our services shall be filed in the appropriate court in Juniata County or Central Pennsylvania.
